The purpose of our Neutral Fact-Finding Discussions is to ascertain the material facts and the reasons for them often in connection with grievance and disciplinary matters.
We can conduct these by phone, video-conference and, subject to security safeguards, by email.
These discussions are 'on the record'. Notes will be taken at the time and a copy will be sent as soon as possible afterwards to those who participated. Others present may also take notes. However, no other form of recording the discussion is permitted.
All participants may be accompanied by one work colleague of their choice who may speak when invited to do so. The role of a companion during these discussions is to provide support when requested but not to act as the participant's representative unless this has been agreed with us beforehand.
Our neutral will prepare a report of their findings and send a copy as soon as possible to both the employer and employee(s) directly concerned.
Our practice is to issue a 'preliminary report' which sets out the material facts but without views or findings.
Based on that report, the participants can either -
We can, if requested, account for our report/s during any subsequent formal proceedings.
